1. Overview

Welcome to Emilby.

These Terms of Service (“Terms”) govern your access to and use of emilby.com, including all related information, features, products, and services offered through our Shopify-powered online store (collectively, the “Services”).

The terms “Emilby,” “we,” “us,” and “our” refer to the operator of the Emilby online store. The terms “you” and “your” refer to customers, visitors, and other users of the Services.

By accessing our website, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

2. Eligibility and Customer Accounts

You must be at least the age of majority in your province, territory, state, or country of residence to make a purchase from Emilby.

When placing an order or creating an account, you agree to provide accurate, complete, and current information, including your name, email address, billing details, and shipping address.

You are responsible for protecting your account credentials and for activity conducted through your account. Please notify us at info@emilby.com if you believe your account has been accessed without authorization.

3. Products and Product Information

We make reasonable efforts to provide accurate product descriptions, photographs, specifications, pricing, and availability information.

Product colours and appearance may vary slightly depending on lighting, photography, screen type, and device settings. Packaging may also differ from images displayed on the website.

Product features, availability, specifications, and prices may be changed or updated when reasonably necessary. We may limit product quantities or discontinue products at any time.

Products must be used according to the provided instructions and only for their intended household purpose.

4. Orders

Submitting an order constitutes an offer to purchase the products in your cart.

An order is not accepted until payment has been successfully authorized and Emilby has issued an order confirmation. We reserve the right to decline or cancel an order for legitimate reasons, including:

• Product unavailability.

• Incorrect pricing or product information.

• Payment authorization failure.

• Suspected fraud or unauthorized activity.

• Shipping restrictions.

• Duplicate or unusually large orders.

If we cancel an order after payment has been received, the applicable amount will be returned to the original payment method.

Please review your products, quantities, email address, and shipping address carefully before submitting an order.

If you need to request an order change or cancellation, contact info@emilby.com as soon as possible. We cannot guarantee changes or cancellations after an order has entered processing or fulfillment.

5. Prices, Discounts, and Payment

Unless otherwise stated, prices displayed on Emilby are in Canadian dollars (CAD).

The final price, applicable discounts, taxes, and shipping charges will be displayed at checkout before payment is submitted.

Promotions and quantity discounts may be subject to eligibility requirements, dates, product quantities, and other conditions displayed with the offer. Discounts cannot be combined unless expressly stated.

Emilby may correct genuine pricing or calculation errors. If an error affects an order that has already been submitted, we will contact you before proceeding or cancel and refund the affected order.

Payments are processed securely by Shopify and authorized third-party payment providers. You confirm that you are authorized to use the payment method submitted with your order.

We do not directly store complete credit card numbers.

6. Shipping and Delivery

Emilby currently provides free tracked shipping across Canada unless otherwise stated at checkout.

The estimated delivery time is generally 6–12 business days. Delivery estimates are not guaranteed and may be affected by order processing, carrier delays, customs procedures, severe weather, holidays, incorrect address information, or other circumstances outside our reasonable control.

When available, tracking information will be sent to the email address provided with your order.

Customers are responsible for providing a complete and accurate delivery address. Emilby is not responsible for delays or failed deliveries caused by incomplete or incorrect address information supplied by the customer.

If a package is returned because of an incorrect address, refusal, or repeated unsuccessful delivery attempts, additional shipping costs may apply before it can be shipped again.

Any taxes, duties, or import charges that are not collected at checkout may be the customer’s responsibility where applicable.

Please contact info@emilby.com if tracking indicates that a package has been delivered but you have not received it.

7. Returns, Damaged Products, and Refunds

Returns, replacements, cancellations, and refunds are governed by our published Refund Policy, which forms part of these Terms.

Please inspect your order after delivery. If your product arrives damaged, defective, incomplete, or different from what you ordered, contact info@emilby.com within the period stated in our Refund Policy.

Your message should include:

• Your name.

• Order number.

• A description of the problem.

• Clear photographs or video showing the product, packaging, and issue.

Approved refunds are issued to the original payment method. Processing times may depend on your bank or payment provider.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be waived or excluded.

8. Product Use and Safety

Customers are responsible for reading and following all product instructions, warnings, charging guidance, installation instructions, and safety information.

Do not use a product if it appears damaged, overheats, has exposed wiring, or otherwise appears unsafe.

Products must not be modified or used in a manner inconsistent with their intended purpose. Keep electrical and rechargeable products away from conditions for which they are not designed.

9. Intellectual Property

The Emilby name, logo, website design, original text, graphics, branding, and other content created for the Services are owned by or licensed to Emilby and are protected by applicable intellectual property laws.

Product images or materials supplied by manufacturers, fulfillment providers, Shopify, or other licensors remain the property of their respective owners.

You may access the website for personal, lawful, and non-commercial purposes. You may not reproduce, copy, distribute, modify, republish, sell, or commercially exploit our content without prior written permission.

10. Third-Party Services and Links

Our Services may include tools, applications, payment services, fulfillment services, shipping services, or links operated by third parties.

These third-party services may be subject to their own terms and privacy policies. Emilby is not responsible for independent third-party websites or services that are outside our reasonable control.

You should review the applicable terms and privacy policies before using a third-party service.

11. Relationship With Shopify

The Emilby online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and Services.

Purchases made from Emilby are transactions between you and Emilby. Shopify is not the seller of Emilby products and is not responsible for product fulfillment, customer support, returns, refunds, or claims arising from your purchase, except where Shopify separately provides a payment or customer service directly to you.

12. Reviews and Feedback

If you voluntarily submit a review, photograph, suggestion, or other feedback, you confirm that:

• The content reflects your genuine experience.

• You have the right to submit it.

• It does not violate another person’s rights.

• It is not unlawful, misleading, abusive, or fraudulent.

• You will disclose any incentive or compensation connected to the submission.

You grant Emilby a non-exclusive, worldwide, royalty-free right to display, reproduce, and use submitted feedback for operating and promoting the Services.

We may remove content that is fraudulent, unlawful, abusive, unrelated, or violates these Terms.

13. Prohibited Uses

You may not use the Services:

• For unlawful, fraudulent, or malicious purposes.

• To submit false, misleading, or fraudulent information.

• To interfere with the website’s security or operation.

We may correct errors, update information, or cancel an affected order when reasonably necessary. If a paid order is cancelled, the applicable amount will be refunded to the original payment method.

We do not guarantee that the website will always be available, uninterrupted, or free from technical errors.

15. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

By using the Services, you acknowledge that Shopify and relevant service providers may process information necessary to operate the store, complete payments, fulfill orders, provide support, and maintain security.

16. Disclaimer of Warranties

To the extent permitted by applicable law, the Services and products are provided on an “as available” basis.

We do not make warranties beyond those expressly stated on the website, in the product documentation, or required by applicable law.

Nothing in these Terms excludes warranties, guarantees, conditions, or consumer rights that cannot legally be excluded.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Emilby and our service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of the Services or products.

Our total liability relating to a purchased product will not exceed the amount paid for the affected product, except where a different remedy is required by applicable law.

These limitations do not apply to liability that cannot legally be limited or excluded.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold Emilby harmless from third-party claims, damages, or reasonable costs resulting from your unlawful use of the Services, violation of these Terms, or infringement of another person’s rights.

19. Termination

We may suspend or terminate access to the Services if you materially violate these Terms, misuse the website, engage in suspected fraud, or threaten the security or lawful operation of the Services.

Any obligations incurred before termination, including outstanding payment obligations, will continue to apply.

20. Severability and Waiver

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

A failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

21. Assignment

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations as part of a legitimate business reorganization, financing, merger, acquisition, or sale, subject to applicable law.

22. Governing Law and Consumer Rights

These Terms are governed by the laws applicable in the jurisdiction where Emilby is established, without regard to conflict-of-law principles.

However, these Terms do not remove or reduce any mandatory consumer rights available under the laws of the customer’s province, territory, state, or country of residence.

Disputes should first be submitted to info@emilby.com so that we have an opportunity to resolve the matter directly.

23. Changes to These Terms

We may update these Terms to reflect changes to our Services, products, business practices, or legal obligations.

The revised Terms will be published on this page with an updated “Last updated” date. Continued use of the Services after an update constitutes acceptance of the revised Terms where permitted by law.
